Canada has announced significant changes to the Open Work Permit (OWP) eligibility criteria for family members of temporary residents, effective January 21, 2025. These updates aim to enhance the integrity of Canada's immigration programs while addressing economic and labor market needs.     1. Occupational Requirements:
      1. Employed in TEER 0 or 1 occupations.
      2. Employed in select TEER 2 or 3 occupations within sectors experiencing labor shortages or aligned with government priorities, including:
        1. Natural and applied sciences.
        2. Construction.
        3. Health care.
        4. Natural resources.
        5. Education.
        6. Sports and military sectors.
    2. Work Permit Validity: The principal foreign worker must have at least 16 months remaining on their work permit at the time their spouse applies for the OWP.
  3. Ineligibility of Dependent Children: Dependent children of foreign workers are no longer eligible for OWPs under these new measures.

Implications for Current Open Work Permit Holders

  • Existing OWPs approved under previous criteria will remain valid until their expiration.
  • In-Canada family members, including spouses and dependent children, can apply to renew their work permits if:
    • They apply under the same criteria as their current permit.
    • The renewal duration matches the existing study or work permit of the principal applicant.

Exceptions to the New Regulations

  • Spouses of workers covered by free-trade agreements.
  • Spouses of individuals transitioning to permanent residence.

These groups will not be affected by the recent changes.
